Texas Landlord-Side FAQ Key Info
Illegal Lockout (Tex. Prop. Code § 92.0081)
Texas law prohibits landlords from using self-help eviction methods. A landlord changing the locks outside of the statute's exact requirements may face:
• One month's rent + $1,000 civil penalty
• Actual damages
• Court costs and attorney’s fees
• Possible wrongful eviction exposure
• Immediate tenant re-entry rights
Failure to Repair (Tex. Prop. Code § 92.056 & § 92.0563)
Texas landlords must diligently repair any condition affecting a tenant’s physical health or safety after receiving proper notice. Exposure for failing to repair can include:
• One month's rent + $500 civil penalty
• Court-ordered repairs
• Rent reduction (retroactive)
• Actual damages
• Court costs and attorney’s fees
Tenants may also improperly attempt repair-and-deduct; landlords have defenses under § 92.058.
Failure to Refund Security Deposit (Tex. Prop. Code § 92.103–§ 92.109)
Landlords must refund security deposits or provide a written itemization within 30 days of surrender. Liability for failing includes:
• Three times the amount wrongfully withheld
• $100 statutory penalty
• Attorney’s fees and court costs
Strong documentation and move-out procedures minimize risk.
Retaliation (Tex. Prop. Code § 92.331–§ 92.335)
Landlords cannot retaliate against tenants for exercising legal rights (repair requests, code complaints, etc.). Penalties may include:
• One month's rent + $500
• Actual damages
• Attorney’s fees and court costs
• Injunctive or declaratory relief
The statute presumes retaliation for six months after tenant action, making documentation critical.
